• Terms and Conditions for Proactive Driving

    • 1. Instructor Status and Contractual Liability 
      • All of our instructors are franchised to Proactive Driving and are self-employed. Your contract is solely between you and your instructor. Proactive Driving acts as an agent for your instructor, and any payments, information, or documentation made to or by Proactive Driving is done so with us acting as agent for your instructor.
      • Proactive Driving’s role is administrative (e.g., booking and payment), and no contractual liability shall arise or exist between the pupil and Proactive Driving for the delivery of the instruction, vehicle quality, or direct service issues.
    • 2. Lesson Cancellation and Rearranging 
      • If you wish to cancel or rearrange any driving lessons, you must give a minimum of 48 hours notice to your instructor.
      • Cancellations must be communicated directly to your instructor (e.g., via phone call or text message). Failure to give this notice will require the full lesson time that was booked in being paid for. It is for you to ensure your instructor is fully aware of the cancellation.
    • 3. Delays, Cancellations, and Non-Arrival
      • Our instructors cannot be held responsible for delays or cancellations due to traffic or weather conditions. If a lesson is running late, your instructor will make every effort to inform you. If a lesson starts after the agreed time, every effort will be made to make up that time at the end of the lesson. Any losses occurring to the student because of late or non-arrival (e.g., test fees) will not be covered by Proactive Driving or your instructor.
    • 4. Driving Test Booking
      • You must only book your driving test when advised to by your driving instructor for a date and time agreeable between you and your instructor.
    • 5. Test Fees
      • Any lesson or course fees paid do not include DVSA practical or theory test fees. These are payable direct to the DVSA.
    • 6. Use of Car for Test
      • Once a test is booked, if you do not reach the required standard for test, your instructor reserves the right to refuse the use of the tuition car for the test.
    • 7. Block Booking Expiration & Forfeit 
      • Once payment for a course or a block booking is received, you are agreeing to take that number of lessons. Remaining credit for lessons will expire should you decide not to carry on, or should you stop taking lessons, if 56 days has elapsed from your last lesson or last cancelled lesson. Refunds will not be given for any student who decides to stop lessons outside of the refund criteria below.
    • 8. Course Deposits & Payment
      • A minimum non-refundable deposit of 20% is required to secure any pre-booked course. Up until payment of the deposit, the dates agreed on the course are not secure. Should you not wish to continue with the agreed course after paying the deposit, then the deposit shall be lost.
      • Full payment for any course is required before the course commences.
    • 9. Pricing
      • Prices are valid at the point of payment. Prices may increase at any point during your tuition.
      • Prices may vary depending on location, day, and time.
    • 10. Driving Licence and Health
      • The driving licence shown to your instructor must be valid. Should any changes to your licence occur affecting your ability to drive, you must inform your instructor immediately.
      • Should any changes to your health or eyesight occur that affect your ability to drive, you need to inform your instructor immediately.
    • 11. Instructor’s Right to Refuse Instruction 
      • Your instructor reserves the right to refuse instruction and cancel the lesson if the student is unfit to drive or unable to safely conduct the lesson for any reason. This includes, but is not limited to, suspected intoxication (drink or drugs), injury, illness, poor eyesight, or the student’s personal condition (e.g., inappropriate footwear, lack of reasonable personal hygiene) which, in the instructor’s professional opinion, poses a safety risk or disrupts the learning environment. In such cases, the instructor will reserve the right to cancel but still charge for the lesson.
    • 12. Media Usage
      • Any photographs or videos taken during lessons or test may be used for training or advertising purposes.
    • 13. Fines and Penalties
      • Any fines incurred during use of the vehicle (e.g., speeding) will be given to the driver at the time of the fine as per the Road Traffic Act.
    • 14. Vehicle Damage & Breakdowns
      • Any damage or breakdowns that occur during a driving lesson will result in the lesson being cancelled at that point and the rest of the lesson forfeited. Damage and repairs will be covered by the instructor in this situation UNLESS the damage is wilful, through careless or dangerous driving, or through negligence on the part of the pupil.
      • Any damage that occurs to the vehicle during a practical driving test will be paid for by the driver at that time.
      • Should any damage or faults occur with your instructor’s vehicle prior to lessons or test, and the vehicle is unable to be repaired in time, the lesson/test will be cancelled. Your instructor will not be liable for any losses incurred for the loss of lesson/test.
    • 15. Instructor’s Right to Refuse Ongoing Tuition
      • Your driving instructor reserves the right to refuse tuition for any reasonable reason they see fit, including but not limited to, poor attendance, poor timekeeping, or attitude.
    • 16. Complaints Procedure
      • Any complaints, concerns, or enquiries should be made to the individual instructor in the first instance. Usually, this will resolve any issues. Should you wish to escalate that complaint further if it is not resolved, then you should email us at proactivedriving@outlook.com. Should we still not be able to resolve your complaint, then you should take your complaint up with the DVSA through their website address: https://www.gov.uk/complain-about-a-driving-instructor
    • 17. Special Offers
      • Special offers are available to learner drivers only (unless otherwise stated) and are for new customers only, and can be used only once.
      • Special offers are at the discretion of Proactive Driving and may be replaced or withdrawn at any time.
    • 18. Gift Vouchers
      • Gift vouchers issued are non-transferable and have zero cash value. All gift vouchers are recorded and must be redeemed within 6 months of the issue date. Should a refund be requested on a gift voucher, this must be made by emailing us before the voucher expires.
      • A refund will be issued within 14 working days minus an administration fee of 15% of the voucher value or £15 (whichever is higher). No refunds will be given for part used gift vouchers.
    • 19. Refund Calculation for Block/Discounted Bookings (Revised & Clarified)
      • Refunds are only issued for uncompleted lessons and are subject to the following calculation to account for discounts/offers already received:
      • Calculation: The total paid will have the value of all lessons already taken deducted at the full current standard hourly rate, not the discounted rate. The balance will then be subject to a 15% or £15 administration fee (whichever is higher).
      • Example of Refund Calculation (for clarity):
        • Student pays £280 for a 10-hour block booking.
        • The current standard hourly lesson rate is £30.
        • Student takes 2 lessons before requesting a refund.
        • Value of lessons taken: 2 hours $\times$ £30/hour = £60
        • Remaining Balance: £280 – £60 = £220
        • Administration Fee (15% of £220): £33 (Since £33 is greater than £15, this is the fee used)
        • Refund Due: £220 – £33 = £187
    • 20. Data Protection
      • Proactive Driving, its agents, or franchised instructors will not sell or otherwise disclose student details to any third party unless required to do so by law.
    No debit/credit card details are stored by Proactive Driving.
