1. Instructor Status and Contractual Liability

All driving instructors operating under the Proactive Driving brand are self-employed franchisees. Your contract for the provision of driving tuition is solely between you (the pupil) and your assigned individual instructor.

Proactive Driving Limited acts strictly as an administrative agent for your instructor. Any payments, bookings, information, or documentation processed through the website or company customer service channels are handled by Proactive Driving Limited acting solely as an agent on behalf of the instructor.

Proactive Driving Limited’s role is purely administrative (e.g., payment processing and diary management). No contractual liability shall arise or exist between the pupil and Proactive Driving Limited for the direct delivery of driving instruction, vehicle quality, or service issues.

2. Lesson Cancellation and Rearranging

  • If you wish to cancel or rearrange any driving lessons, you must give a minimum of 48 hours’ notice to your instructor.

  • Cancellations must be communicated directly to your instructor (e.g., via a direct phone call or text message).

  • Failure to give the required 48 hours’ notice will result in the full lesson fee for the booked duration being charged and forfeited. It is the pupil’s responsibility to ensure their instructor is fully aware of the cancellation.

3. Delays, Cancellations, and Non-Arrival

Instructors cannot be held responsible for delays or cancellations resulting from traffic congestion, vehicle breakdowns, or adverse weather conditions. If a lesson is running late, your instructor will make every effort to inform you.

If a lesson starts after the agreed time, every effort will be made to make up that time at the end of the session or roll it over. Any losses occurring to the student due to late or non-arrival (including, but not limited to, DVSA test fees) will not be covered or reimbursed by Proactive Driving Limited or the individual instructor.

4. Driving Test Booking

You must only book your practical driving test when explicitly advised to do so by your driving instructor, for a date and time mutually agreeable between you and the instructor.

5. Test Fees

Any lesson fees, block booking fees, or intensive course fees paid to the Company do not include Driver & Vehicle Standards Agency (DVSA) practical or theory test fees. These must be paid directly by the pupil to the DVSA.

6. Use of Car for Test

Once a driving test is booked, if the pupil has not reached the required safe driving standard for the test, the instructor reserves the sole right to refuse the use of their tuition vehicle for the practical test.

7. Block Booking Expiration & Forfeit

  • Once payment for a course or a block booking is received, you are agreeing to complete that specific number of lessons.

  • Remaining lesson credits will expire and be forfeited should you decide not to carry on, or should you pause lessons, if 56 days have elapsed from your last completed lesson or last cancelled lesson.

  • No refunds will be issued for any student who decides to stop lessons outside of the standard refund criteria outlined in Section 19.

8. Course Deposits & Payment

  • A minimum non-refundable deposit of 20% is required to secure any pre-booked intensive or semi-intensive driving course. Course dates are not reserved or secure until this deposit is paid and cleared. Should you wish to cancel the agreed course after paying this deposit, the deposit is completely non-refundable.

  • Full cleared payment for any block booking or course is required before the first lesson commences.

9. Pricing

  • Lesson prices are valid at the point of payment. Prices may increase at any point during your ongoing tuition.

  • Standard prices may vary depending on location, operational area, day of the week, and time of day.

10. Driving Licence and Health

  • The driving licence presented to your instructor must be valid, current, and legally entitlement-checked. Should any changes to your licence or legal status occur affecting your ability to drive, you must inform your instructor immediately.

  • Should any changes to your health, physical fitness, or eyesight occur that legally affect your ability to drive, you must inform your instructor immediately.

11. Instructor’s Right to Refuse Instruction

Your instructor reserves the absolute right to refuse instruction and cancel a scheduled lesson if the student is deemed unfit to drive or unable to safely conduct the lesson for any reason.

This includes, but is not limited to: suspected intoxication (alcohol or drugs), injury, illness, poor eyesight, or the student’s personal condition (e.g., inappropriate footwear, lack of reasonable personal hygiene) which, in the instructor’s professional opinion, poses a safety risk or disrupts the learning environment. In such cases, the instructor will cancel the lesson and charge the pupil the full rate.

12. Media Usage

Any photographs, dashcam clips, or video recordings taken during lessons or immediately following a driving test success may be used by the Company and instructor for professional training, social media, or marketing/advertising purposes.

13. Fines and Penalties

Any road traffic offenses, motoring fines, or penalties incurred during the use of the vehicle (e.g., speeding fines, camera offences) will be legally allocated to the pupil driving at the time of the offence, in strict accordance with the Road Traffic Act.

14. Vehicle Damage & Breakdowns

  • Any vehicle damage or sudden mechanical breakdowns that occur during a driving lesson will result in the lesson being safely concluded at that point, and the remaining time forfeited. Damage and repairs will be covered by the instructor unless the damage is proven to be wilful, caused through reckless/dangerous driving, or through gross negligence on the part of the pupil.

  • Any damage that occurs to the vehicle during an official practical driving test caused by pupil error will be paid for by the driver at that time.

  • Should a mechanical fault occur with your instructor’s vehicle prior to a lesson or test, and the vehicle cannot be repaired in time, the lesson/test will be cancelled. Your instructor and Proactive Driving Limited will not be liable for any losses incurred due to the loss of a lesson or test booking.

15. Instructor’s Right to Refuse Ongoing Tuition

Your driving instructor reserves the right to terminate ongoing tuition and refuse further lessons for any reasonable cause they see fit, including but not limited to, poor attendance, persistent poor timekeeping, or a disruptive/unsafe attitude.

16. Complaints Procedure

Any complaints or concerns should be directed to your individual instructor in the first instance. If the issue is not resolved, you may escalate the complaint by emailing proactivedriving@outlook.com for a corporate review by the management team. Should we still be unable to resolve your complaint, you should escalate the matter to the DVSA via their official channel: https://www.gov.uk/complain-about-a-driving-instructor.

17. Special Offers

  • Special offers or introductory rates are strictly available to learner drivers only (unless otherwise specified), apply only to brand-new clients, and can be redeemed only once per person.

  • All special offers are managed at the sole discretion of Proactive Driving Limited and may be modified or withdrawn entirely at any time without notice.

18. Gift Vouchers

  • Gift vouchers issued by the Company are non-transferable, non-extendable, and hold zero cash value. All gift vouchers must be redeemed within 6 months of the exact issue date.

  • Refund requests for unredeemed vouchers must be submitted via email before the voucher expires. Approved refunds will be issued within 14 working days, subject to an administration fee of 15% of the total voucher value or £15 (whichever is the higher amount). No partial refunds will be given for part-used gift vouchers.

19. Refund Calculation for Block/Discounted Bookings

Refunds are only issued for uncompleted lessons and are subject to a standard calculation to account for any bulk-buy discounts or promotional offers previously received:

  • Calculation: The total initial amount paid will have the value of all lessons already taken deducted at the full current standard hourly rate, not the discounted rate. The remaining balance will then be subject to a 15% or £15 administration fee (whichever is higher).

  • Example of Refund Calculation:

    • Student pays £280 for a 10-hour block booking.

    • The current standard hourly lesson rate is £30.

    • Student takes 2 hours of lessons before requesting a refund.

    • Value of lessons taken: 2 hours $\times$ £30/hour = £60.

    • Remaining Balance: £280 – £60 = £220.

    • Administration Fee (15% of £220): £33 (Since £33 is greater than £15, this fee applies).

    • Total Refund Issued: £220 – £33 = £187.

20. Data Protection

Proactive Driving Limited, its administrative staff, and its franchised instructors process personal data in strict compliance with the UK GDPR. We will never sell, lease, or disclose student details to any third party unless legally compelled to do so by law enforcement or regulatory authorities. No payment card details are stored directly on our company servers.
