- How We Use Your Data (The Purpose of Processing)
We use your personal data for the following purposes:
- To Fulfil Our Contract: To arrange, manage, and deliver driving lessons, schedule driving tests, and manage payments.
- Communication: To contact you regarding bookings, cancellations, changes, or service updates.
- Legal Compliance: To comply with legal requirements, such as maintaining accurate tax records or providing evidence to the police/DVSA if legally required.
- Security & Safety: In some cases, to utilise Dashcam footage (which may incidentally record you) solely for the purpose of ensuring road safety, preventing fraud, or for use in insurance claims/disputes.
- Data Security and Storage
Proactive Driving takes the security of your data seriously. We have implemented appropriate physical, electronic, and managerial procedures to safeguard the information we collect:
- Physical Records (Paper): Paper-based records (such as progress cards) are kept to a minimum and stored in a locked cabinet at the registered office (13 Westkirke Avenue, Grimsby, DN33 2HS) or securely within the instructor’s property when not in use during a lesson. They are never left unattended in the vehicle overnight.
- Electronic Records: Data stored on computers, phones, or tablet devices is password-protected and/or encrypted. We use reputable, password-protected diary management software for lesson scheduling.
- Data Minimisation: We only retain data for as long as necessary.
- Data Retention Period
We will only retain your personal data for as long as is necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
- Learning/Contact Data: Typically, this data is retained for a maximum of one year after your last lesson or driving test date, unless required for legal/insurance purposes.
- Financial Records: Retained for a minimum of six years after the tax year end to comply with HMRC requirements.
- Your Data Rights (The Rights of the Individual)
Under UK GDPR, you have the following rights regarding the personal data we hold about you:
- Right to be Informed: To know how your data is being used (which is the purpose of this policy).
- Right of Access (Subject Access Request – SAR): To request a copy of the personal data we hold about you. We will respond within one month.
- Right to Rectification: To have inaccurate or incomplete data corrected.
- Right to Erasure (‘Right to be Forgotten’): To request the deletion of your personal data where there is no compelling reason for us to continue processing it.
- Right to Restrict Processing: To ‘block’ or suppress the processing of your personal data.
- Right to Data Portability: To obtain and reuse your personal data for your own purposes across different services.
- Right to Object: To object to processing based on legitimate interests or direct marketing.
